Membership Agreement & Terms

Welcome to Pace + Power Training. We are committed to providing a safe, respectful, and focused training environment where members can train independently and achieve their fitness goals.

This Membership Agreement & Terms of Membership (“Agreement”) governs the purchase and use of memberships, visit passes, facility access, and services provided by Pace + Power Training.

By purchasing a membership or pass, creating a member account, accessing the facility, or using any services provided by Pace + Power Training, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. Membership Agreement

This Agreement is entered into between Pace + Power Training (“Pace + Power”) and each individual who purchases a membership or pass.

A member’s access to the facility is limited to the membership or pass purchased. Memberships and passes are personal, non-transferable, and may not be shared unless expressly authorized in writing by Pace + Power Training.

Members agree to comply with this Agreement, all facility rules, reservation requirements, and operational policies established by Pace + Power Training. These policies are intended to maintain a safe, respectful, and enjoyable training environment for all members.

Continued membership and facility access is conditioned upon compliance with this Agreement and the separate Liability Waiver & Release of Liability.

 

2. Membership Eligibility

Membership is available to individuals who meet Pace + Power Training’s eligibility requirements. Members under the age of 18 may become members only with the consent of a parent or legal guardian. A parent or legal guardian must complete and/or sign any required membership documents, waivers, and agreements on behalf of the minor.

 

Members must provide accurate and current information during registration and promptly update any changes to their contact information.

 

3. Membership Types

Pace + Power Training currently offers the following membership options:

  • Single Visit Pass

  • 5 Visit Pass

  • 10 Visit Pass

  • Monthly Unlimited

The benefits, pricing, expiration dates, and facility access associated with each membership or pass are determined by the option purchased.

Memberships and punch passes:

  • are non-transferable;

  • may not be shared or resold;

  • have no cash value unless required by law; and

  • will expire according to the membership or pass duration displayed at the time of purchase.

 

4. Facility Access

Facility access is provided through an authorized method designated by Pace + Power Training. Pace + Power Training reserves the right to change access method at any time.

Members are responsible for maintaining the security of their authorized access credentials. Members shall not provide facility access to any unauthorized individual.

Members are responsible for ensuring the facility is secure when entering or leaving and shall not permit access to anyone who is not authorized to use the facility.

Access to the facility may be suspended or revoked for failure to comply with this Agreement, nonpayment, misuse of the facility, or conduct that jeopardizes the safety or security of members or the facility.

 

5. Reservations

To provide a safe, organized, and high-quality training environment, all workouts require a reservation through Pace + Power Training’s reservation system.

Reservations help manage facility capacity, maintain equipment availability, and ensure an enjoyable experience for all members.

Members are responsible for reserving a workout time before arriving at the facility.

If a member is unable to attend a reserved session, the member should cancel the reservation as soon as possible so another member may reserve the available time.

Repeated no-shows or failure to cancel reservations may result in temporary restrictions on reservation privileges or other action deemed appropriate by Pace + Power Training.

Pace + Power Training reserves the right to cancel or modify reservations when reasonably necessary for facility operation, maintenance, safety, or unforeseen circumstances.

 

6. Member Responsibilities

Members agree to:

  • Treat fellow members, guests, staff, and neighboring businesses and their patrons with courtesy and respect.

  • Follow all facility rules and safety instructions.

  • Use equipment only for its intended purpose.

  • Return equipment to its designated location after use.

  • Report damaged or malfunctioning equipment promptly.

  • Maintain appropriate personal hygiene and wear suitable athletic attire.

  • Help maintain a clean training environment by disposing of trash and wiping down equipment after use.

Members shall not:

  • Engage in unsafe, reckless, abusive, threatening, or illegal behavior.

  • Intentionally damage facility property or equipment.

  • Use another person’s membership or permit another person to use theirs.

  • Bring unauthorized individuals into the facility.

  • Use the facility while impaired by alcohol, illegal drugs, or any substance that may create an unsafe environment.

  • Block exits or create a safety hazard.

Failure to comply with these responsibilities may result in suspension or termination of membership, without refund where permitted by applicable law.

 

7. Use of Equipment

Members are expected to use all equipment in a safe and responsible manner and only for its intended purpose.

Members agree to:

  • Inspect equipment before use and discontinue use immediately if it appears damaged or unsafe.

  • Return all equipment to its designated storage location after use.

  • Wipe down equipment after each use using the cleaning supplies provided.

  • Report damaged or malfunctioning equipment to Pace + Power Training as soon as possible.​​

 

Members are responsible for exercising within their own physical abilities. Pace + Power Training does not provide supervision or instruction during independent workouts unless separately arranged.

Members may be responsible for the cost of repairing or replacing equipment or facility property intentionally damaged by the member. Intentional damage may also result in suspension or termination of membership.

 

8. Membership Fees & Payments

Membership fees are due at the time of purchase unless otherwise agreed in writing by Pace + Power Training.

Accepted payment methods are determined by Pace + Power Training and may change from time to time.

Memberships and passes do not automatically renew. Members must purchase a new membership or pass upon expiration if they wish to continue using the facility.

Pace + Power Training reserves the right to modify membership pricing for future purchases. Price changes will not affect memberships or passes that have already been purchased unless otherwise disclosed at the time of purchase.

 

9. Refund & Cancellation Policy

Unless otherwise required by law, all membership and pass sales are final.

If a member accidentally purchases the wrong membership or pass and notifies Pace + Power Training before any facility use, Pace + Power Training may, at its sole discretion:

  • issue a refund; or

  • apply the payment toward the intended membership or pass.

Once any portion of a membership or pass has been used, it is generally not eligible for a refund, exchange, transfer, or credit except as required by law.

Unused memberships and passes have no cash value and may not be redeemed for cash. Memberships and passes may not be transferred to another individual.

 

10. Membership Transfers & Termination

Memberships and punch passes are issued solely to the purchasing member and may not be transferred, assigned, shared, sold, or exchanged.

Pace + Power Training reserves the right to suspend or terminate a membership for violations of this Agreement, misuse of the facility, fraudulent activity, non-payment, or conduct that threatens the safety, security, or enjoyment of the facility by others.

Termination of membership under this section does not entitle the member to a refund unless required by law.

 

11. Facility Closures

Pace + Power Training may temporarily close the facility due to circumstances including, but not limited to:

  • severe weather;

  • power outages;

  • emergency maintenance;

  • equipment repairs;

  • building repairs;

  • public safety concerns; or

  • other circumstances beyond the reasonable control of Pace + Power Training.

 

Temporary closures do not automatically entitle members to refunds.

For punch pass holders, Pace + Power Training may restore a visit lost due to a qualifying facility closure.

For extended closures, Pace + Power Training may, at its discretion, provide a membership extension, temporary pause, account credit, or another accommodation.

No accommodation is guaranteed except where required by law.

 

12. Security & Surveillance

To promote the safety and security of members and the facility, Pace + Power Training may utilize security measures including, but not limited to, video surveillance, entry monitoring, alarm systems, and access records.

By using the facility, members acknowledge and consent to these security measures.

Video recordings and access records may be used for security, safety, maintenance, incident investigation, or other legitimate business purposes, as permitted by law.

 

13. Collection and Use of Information

Pace + Power Training collects personal information necessary to administer memberships, communicate with members, process payments, maintain facility security, and provide member services.

Information may include, but is not limited to:

  • Name

  • Address

  • Email address

  • Telephone number

  • Emergency contact information

  • Membership and reservation history

  • Payment information necessary to process transactions (processed through third-party payment providers)

 

Pace + Power Training does not sell members’ personal information.

Information may be shared only with trusted service providers when necessary to operate the business or when required by law.

Members are responsible for keeping their contact information current.

 

14. Communications

By purchasing a membership or pass, members consent to receive communications related to their membership, including:

  • Payment confirmations

  • Reservation confirmations

  • Facility announcements

  • Cancellation confirmations

  • Operational updates

  • Account notifications

  • Safety or emergency communications

 

Members may also choose to receive promotional or marketing communications and may opt out of those communications at any time.

 

15. Emergency Contact Information

Members agree to provide accurate emergency contact information before using the facility and to update that information if it changes.

Pace + Power Training may use this information in the event of a medical emergency or other urgent situation.

 

16. Assumption of Risk

Execution of Pace + Power Training’s separate Liability Waiver & Release of Liability is a condition of membership and facility use. By accepting this Agreement, the member acknowledges that use of the facility is also subject to the terms of the separate Liability Waiver.

 

17. Miscellaneous

This Agreement shall be governed by the laws of the State of Georgia.

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Pace + Power Training reserves the right to reasonably modify facility rules, operating procedures, hours of operation, reservation procedures, and administrative policies as business needs change. Material changes to this Agreement will be communicated to members when required.

Failure by Pace + Power Training to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.

This Agreement, together with the separate Liability Waiver & Release of Liability, constitutes the entire agreement between the member and Pace + Power Training regarding membership and facility use.
